Only a signed written contract defines final pricing, scope of work, and terms.

4. Scope of Work & Hidden Conditions
Masonry work involves materials and conditions that are often concealed.
Cary Masonry is not responsible for:

• Hidden structural defects
• Subsurface settlement
• Concealed moisture intrusion
• Internal wall damage
• Conditions not visible without the removal of materials

If concealed conditions are discovered, additional work and costs may be required and will be addressed separately.

5. Mortar Color & Appearance Disclaimer
Mortar color matching is an approximate process, not an exact match.
By requesting an estimate or engaging Cary Masonry, you acknowledge and agree that:

• Existing mortar color varies due to age, weather exposure, moisture, prior repairs, and environmental conditions.
• New mortar will not appear identical to existing mortar at the time of installation.
• Mortar color changes as it cures and ages.
• Lighting, moisture levels, and viewing conditions affect appearance.
• Cary Masonry does not guarantee a perfect or exact color match, only the closest achievable professional match using standard masonry practices.

Color variation is not considered a defect or workmanship failure.

6. Workmanship & Structural Limitations
Cary Masonry guarantees that work will be performed in a professional manner consistent with accepted masonry practices.
However, Cary Masonry does not guarantee:

• Structural correction of underlying movement
• Permanent prevention of future cracking
• Elimination of moisture intrusion from unrelated sources
• Performance of materials or areas outside the agreed scope of work

Brick and mortar are subject to natural movement, settlement, moisture, and environmental stress over time.

7. Referrals to Other Contractors
Any referrals to third-party contractors are provided as a courtesy only.
Cary Masonry is not responsible for:

• Pricing
• Scheduling
• Workmanship
• Materials
• Actions or omissions of referred contractors

Any agreement entered into with a referred contractor is solely between you and that contractor.

8. Limitation of Liability
To the maximum extent permitted by North Carolina law:

• Cary Masonry shall not be liable for indirect, incidental, special, or consequential damages.
• Cary Masonry’s total liability, if any, shall not exceed the amount paid for the specific work giving rise to the claim.
• Cary Masonry is not responsible for pre-existing conditions, acts of God, or damage outside the agreed scope of work.
